Privacy and Cookie Policy

Information about the processing of personal data

Introduction

Ustronie Park sp. z o.o. values the trust of its Users and therefore stores their data with the utmost care and adherence to the highest security standards, protecting it from unauthorized access.
This Privacy Policy defines the rules for storing and accessing information on the User's device using Cookies, which serve the provision of electronic services requested by the User from Ustronie Park sp. z o.o. Additionally, this privacy policy fulfills an informational purpose.

I. Definitions

a. Administrator – means Ustronie Park limited liability company headquartered in Warsaw, Aleje Jerozolimskie 94, 00-807 Warsaw, registered in the National Court Register of Entrepreneurs under number 0000332716, NIP: 5252459249, REGON 141956284, phone 510 85 90 95, providing electronic services and storing and accessing information on the User's device.

b. Cookies – means IT data, in particular small text files, saved and stored on devices through which the User accesses the Service's websites.

c. Administrator’s Cookies – means Cookies placed by the Administrator related to the provision of electronic services by the Administrator through the Service.

d. External Cookies – means Cookies placed by the Administrator’s partners through the Service's website.

e. Service – means the website or application through which the Administrator runs the internet service operating at the domain www.ustroniepark.pl.

f. Device – means an electronic device through which the User accesses the Service.

g. User – means the entity for whom electronic services may be provided in accordance with the Terms and Conditions and legal provisions, or with whom an electronic services agreement may be concluded.

II. Types of Cookies Used

1. Cookies used by the Administrator are safe for the User’s Device. In particular, these Cookies cannot introduce viruses, unwanted or malicious software to the User’s Devices. These files allow identification of the software used by the User and adapt the Service individually to each User. Cookies usually contain the domain name from which they originate, their storage duration on the Device, and the assigned value.

2. The Administrator uses two types of Cookies:

  • a. Session Cookies: stored on the User’s Device and remain there until the end of the browser session. The stored information is permanently removed from the Device’s memory afterward. The session Cookies mechanism does not allow collecting any personal or confidential information from the User’s Device.
  • b. Persistent Cookies: stored on the User’s Device and remain there until deleted. Closing the browser session or turning off the Device does not remove them from the User’s Device. The persistent Cookies mechanism does not allow collecting any personal or confidential information from the User’s Device.

3. The User may limit or disable Cookies access to their Device. Should this option be used, the Service will be available except for functions that inherently require Cookies.

III. Purposes for Which Cookies Are Used

1. The Administrator uses Own Cookies for the following purposes:

a. Service configuration

  • I. adapting the Service’s web pages content to the User's preferences and optimizing the use of the Service’s web pages.
  • II. recognizing the User's Device and its location, and appropriately displaying the webpage tailored to the User’s individual needs.
  • III. remembering the settings selected by the User and personalizing the User interface, e.g., language or region selection.
  • IV. remembering visited pages in the Service for content recommendations.
  • V. maintaining the User’s session (after login), so the User does not need to re-enter login and password on each subpage.
  • VI. proper configuration of selected Service functions, particularly verifying the authenticity of the browser session.

c. Realizing processes necessary for full functionality of web pages

  • I. adapting the Service’s web pages content to the User’s preferences and optimizing the use of the Service’s web pages. These files allow recognizing basic parameters of the User’s Device and appropriately displaying the webpage tailored to their individual needs.

d. Analysis, research, and viewing audits

  • I. creating anonymous statistics that help understand how Users use the Service’s web pages, enabling improvements in their structure and content.

e. Ensuring the security and reliability of the Service

2. The Administrator uses External Cookies for the following purposes:

a. presenting multimedia content on the Service’s web pages, which are downloaded from an external service:

b. collecting general and anonymous statistical data via analytical tools:

c. presenting ads tailored to the User’s preferences using an internet advertising tool:

d. using interactive functions to popularize the Service via social media platforms:

e. fulfillment and settlement of electronic services provided to the User by the Administrator:

  • Possibilities to determine conditions for storing or accessing Cookies

3. The User can independently and at any time change the settings regarding Cookies, specifying conditions for their storage and access to the User’s Device by Cookies. These changes can be made via browser settings or service configuration. They may include blocking automatic handling of Cookies in browser settings or informing about each placement of Cookies on the User’s Device. 4. The User can delete Cookies at any time using the functions available in their web browser.

5. Limiting Cookies usage may affect some functionalities available on the Service’s website.

V. Personal Data Protection

1. Data Controller

2. Data Processing
Data processing means any operation or set of operations performed on personal data, automated or not, such as collection, recording, organization, structuring, storage, adaptation, modification, retrieval, consultation, use, disclosure by transmission, dissemination, making available, alignment, combination, restriction, erasure, or destruction.

3. Purpose of Data Processing
Data is processed according to GDPR provisions, in clearly defined purposes, and only to the extent necessary to achieve these purposes.
Data voluntarily provided by the User is processed only to the extent consented by the User, for purposes including:
– informing about Ustronie Park sp. z o.o.'s content and services in response to requests or inquiries.
– ordering and providing services offered by Ustronie Park sp. z o.o.
– executing agreements to which the User is a party.
– complying with legal requirements.
– pursuing legitimate interests of the data controller or third parties.

Consequently, we inform you that per Articles 13 and 14 GDPR, we will process the mentioned data for these purposes manually or using IT systems automatically.

4. Data Recipients

Data may be processed by employees and collaborators of Ustronie Park sp. z o.o. authorized to process data under GDPR Articles 4.10 and 4.29. Trusted entities providing technical and organizational services to Ustronie Park may also process data under appropriate contracts or legal instruments compliant with EU law. Data may also be shared with others upon lawful request or when necessary for legitimate purposes of the controller or third parties.

5. Consent to Data Processing

When data processing is not mandated by law, contract, or legitimate interest of Ustronie Park sp. z o.o. or third parties, we will ask your consent to process personal data for the indicated purpose. Such consent may be withdrawn anytime.

6. Objection Against Data Processing

Under Article 21 GDPR, you have the right to object anytime to data processing for stated purposes. Upon objection, data processing for that purpose will cease unless based on law or legitimate interest of the controller or third parties.

7. Transfer of Personal Data to Third Countries

Collected data may be transferred outside the European Economic Area to independent IT service or data storage providers, including cloud storage, only under conditions ensuring data protection and appropriate transfer security, e.g., based on EU Commission standard contractual clauses, Privacy Shield agreements, or equivalently approved agreements, or to countries with adequate data protection levels recognized by the EU. Transfers may also occur if necessary for contract execution with the User or with their consent.

8. Data Retention Period

All personal data is gathered lawfully, for stated purposes, with necessity principles upheld. Data is retained proportionally, allowing identification of the data subject until the processing purposes are fulfilled.

9. Rights of the Data Subject

Under Articles 13.2.b, 13.2.d, 14.2.c, 14.2.e, 15, 18, 19, and 21 GDPR, you have rights to access, rectify, erase, restrict processing, object to processing, data portability, file complaints with the Data Protection Authority, and request rectifications or restrictions as needed.

10. Social Media Plugins

This website may contain plugins for certain social media platforms that enable embedding their functions directly on the site, marked with the respective platform logos. When you visit and use such a plugin, information is transmitted by your browser directly to the social media platform, which stores and processes it. For detailed information about data processing by these platforms and your rights, please consult their privacy policies.

11. Links to Independent Websites

The site may contain links directly connecting to other independent websites. The Administrator is not responsible for how those sites handle personal or authentication data transferred by third parties.

12. Data Collected via Chatbot
We use ChatLab to operate a chatbot on our website, collecting and processing personal data such as chat logs and user interactions, fully compliant with GDPR.

  • Data Types: Chat logs and user interactions.
  • Purpose: Lead generation and service quality improvement.
  • Legal Basis: Data processed based on your consent, which can be withdrawn anytime.
  • Retention Period: Data is stored for 180 days and then automatically deleted.
